Simona Halep received a firm response in the lawsuit she filed in a New York court, seeking damages of 10 million dollars.
Our athlete sued Quantum Nutrition, along with Custom Food Packaging and General Ingredient, after testing positive for Roxadustat due to consuming a contaminated supplement.
She is seeking 10 million euros, but Quantum Nutrition representatives issued a firm response in their defense filed in court, according to Gsp.ro.
"Any damages suffered by the claimant were caused by their own culpable behavior, including contributory negligence and assumption of risks, not by the culpable behavior or negligence of the defendant," Quantum Nutrition stated in their defense.
They argue that Simona demonstrated "contributory negligence." What does this mean? It means that the claimant, Halep, may be denied any compensation if the court finds that, through their behavior and actions, they contributed, even in a minor percentage, to their own damages, as cited by the source.
"By engaging in the activity at the time of the incident in the complaint, the claimant was aware of the inherent dangers and risks involved. Any injuries and damages suffered by the claimant (...) arose and were caused by these voluntarily assumed risks in their activities," Quantum Nutrition further conveyed.
Moreover, Quantum Nutrition accuses Simona Halep of destroying important evidence, without specifying what this evidence is.
"The claimant's claims are barred to the extent that they have destroyed evidence necessary for the fair defense of the claims made," Canadian lawyers representing Quantum Nutrition added.
The trial is set to begin in April, but it may be delayed by the lawyers of the accused parties.
