The protection of the personal data we collect as a result of your visiting the website, contacting the newsroom or using our services is very important to us. We want to be transparent and provide you with all the information you need in order to understand the purpose for which we request certain data, the way in which we use it, and the rights and options available to you.

The Site Administrator will not disclose, sell or rent the personal information of users collected by spotmedia.ro, except where the request is made by a public institution or authority, under the conditions of the law.

The personal data that the spotmedia.ro site collects and processes are the following:

2.1. Newsletter

If you wish to subscribe to the spotmedia.ro newsletter, we ask for your e-mail address. At that e-mail address you will receive a confirmation link valid for 15 days, and only after accessing that link will you be considered a subscriber. The status of subscriber and, implicitly, the processing of the data provided for the purpose of sending newsletters cease upon the withdrawal of the user’s consent following unsubscription, the e-mail address being deleted from our database. Each newsletter sent to subscribers contains an unsubscribe link, which is an automatic way to stop receiving newsletters from us. Each unsubscribe request is processed immediately. We wish to inform you that, for legitimate reasons, we keep a record of the opening of the e-mails containing the spotmedia.ro newsletter, so as to allow us to carry out business analyses. The data provided and confirmed are stored until the moment the subscriber status ceases, while unconfirmed data are stored for only 15 days (as explained above).

2.2. Push notifications

If you subscribe to Push Notifications (browser notifications) by interacting with the bell that appears in the bottom left of the screen on the pages you visit, you can unsubscribe at any time, also by interacting with the bell that appears on this page (Privacy Policy) and on the Terms and Conditions, Cookie Policy and Contact pages, or by following the instructions here.

If you wish to contact us at any of our e-mail addresses, we will use the information sent only in order to communicate with you.

2.4. Online donations

If you choose to support the spotmedia.ro project by making an online donation, we will ask for your e-mail address so that we can communicate with you and assist you in the event of technical problems or if a recurring (monthly) donation is stopped. At that e-mail address you will automatically receive the confirmation of the donation made, together with useful information about the status of the donation and about the possibility of stopping a recurring (monthly) donation. Online donations can be made through the PayPal or Stripe platforms. The spotmedia.ro site does not process donors’ bank card data, this data being processed by the online payment processors, in accordance with their terms and conditions and privacy policies.

spotmedia.ro processes data regarding the payments made (the amount), the usernames of the donors and the pseudonymised card data (in the case of cards, only the type and the last 4 digits of the card are displayed) from the PayPal/Stripe platforms, as well as the first name and surname and the IBAN account for bank transfers. This data is kept in accordance with fiscal and accounting legislation.

2.5. Polls

If you vote in a poll on the site, we will place a cookie for the duration of the voting period and will collect the IP and information about the browser and the device from which you access our site (https://developer.mozilla.org/en-US/docs/Web/HTTP/Headers/User-Agent) in order to avoid a multiple-voting situation. 30 days after the poll’s closing date, the collected data specified above will be automatically deleted from the database.

2.6. Cookies

In order to manage the website and to provide you with improved browsing, both the spotmedia.ro site and its partners (social networks, advertising providers, traffic and audience analytics providers) use cookies to collect aggregated data. Cookies are used to enable the optimal display of content, to personalise the interface, to compile statistics for understanding the audience and to deliver advertising. These sites operate independently of spotmedia.ro and may have their own notices, statements or privacy policies, which we recommend you consult. SPOT AGENCY S.R.L. is not responsible for the content of sites that do not belong to or are not managed by spotmedia.ro, or for the use or privacy practices of those third-party sites.

When you share or recommend links to content on a third-party platform (for example, but not limited to, a share or like on Facebook), that action and any data you share will be covered by the privacy policy of the respective platform.

4. Transfer of data outside the EU

All personal data collected by the spotmedia.ro site are stored within the European Union (“EU”) and the European Economic Area (“EEA”) or in countries that provide an adequate level of personal data protection, established on the basis of objective criteria by the EU.

The personal data collected and processed by third parties (social networks, advertising providers, traffic and audience analytics providers) are subject to the privacy policies of the respective service providers. spotmedia.ro uses third-party codes (for example, but not limited to this example, Google Analytics).

7. Users’ rights

In accordance with the provisions of the General Data Protection Regulation, Chapter III Rights of the data subject, Art. 12 – 22, data subjects benefit from the following rights:

7.1. The right to be informed

Through this Privacy Policy, the users of the spotmedia.ro services are informed about the identity and contact details of the controller, the contact details of the data protection officer, the categories of data processed, the purposes and legal grounds of the processing of personal data, the transfer to third countries or international organisations, as well as the rights of data subjects and the way to exercise them.

7.2. The right of access to data

Users have the right to obtain from us a confirmation as to whether or not personal data concerning them are being processed and, if so, access to that data and appropriate information. At the users’ request, we can provide, in electronic format, a copy of the personal data undergoing processing. 7.3. The right to rectification

Users have the right to request the rectification of inaccurate personal data, respectively the completion of personal data that are incomplete, including by providing a supplementary statement. 7.4. The right to erasure of data (“the right to be forgotten”)

7.5. The right to restriction of processing

You may request the restriction of the processing of your personal data in cases where it is not clear whether and when the personal data will have to be erased. This right may be exercised when:

  • the accuracy of the data in question is contested;
  • you do not want the data to be erased;
  • the data are no longer needed for the original purpose, but cannot yet be erased for legal reasons;
  • a decision regarding your objection is awaited.

“Restriction” means that – except for storage – your personal data may be processed only with your consent, for the establishment, exercise or defence of a legal claim, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the EU or of an EU member state.

7.6. The right to data portability

The user has the right to receive the personal data concerning them and which they have provided to the controller in a structured, commonly used and machine-readable format, and has the right to transmit that data to another controller. Your right to receive your personal data must not adversely affect the rights and freedoms of others. This could happen if a transmission of your personal data to another organisation also involves the transmission of the personal data of other persons (who do not give their consent to that transfer). In exercising the right to data portability, the user has the right to have the personal data transmitted directly from one controller to another where this is technically feasible. 7.7. The right to object

7.8. The right not to be subject to automated individual decision-making

Profiling takes place when your personal aspects are evaluated in order to make predictions about you, even if no decision is taken. You have the right to request that such evaluations be stopped. 9. Response times for requests/complaints

Our team will make all the necessary efforts to resolve your requests in the shortest possible time. According to the legislation in the field of personal data protection, the response time is 30 days. If, depending on the complexity of the request, we cannot implement the requested measures within a period of less than 30 days, this period may be extended, in accordance with the applicable legislation, by a maximum of 60 days. In this situation, you will receive a notification within 30 days of receipt of the request, regarding the reasons for the delay.

10. Modification of the privacy policy

Each time we modify the privacy policy, we will post the new version on the site. The new privacy policy will enter into force on the date of its publication on spotmedia.ro. The privacy policy is part of the terms and conditions for using the spotmedia.ro services.
