With a majority of votes, the Constitutional Court decided that the complaint of the Government of Ilie Bolojan against the decision of the Supreme Court, led by Lia Savonea, was declared inadmissible.
Consequently, taxpayers in Romania are required to pay one billion euros in compensation and salary arrears to judges who have created a loophole to make decisions in their own interest.
In other words, the way in which magistrates sue the state to increase their incomes has been validated by the Constitutional Court.
"...the request of Mr. Ilie Bolojan, Prime Minister of the Government, regarding the existence of a legal conflict of a constitutional nature between the Government of Romania, on the one hand, and the High Court of Cassation and Justice, on the other hand, exceeds the scope of the legal conflict of a constitutional nature and aims to use the attribution provided for in art.146 lit.e) of the Constitution for the purpose of reforming a solution pronounced by a judicial court, a purpose incompatible with the competence of the Constitutional Court", according to the official statement of the Constitutional Court.
In simpler terms, the Constitutional Court washes its hands, avoiding to resolve one of the greatest interferences of the judiciary in the sphere of the executive power, with major consequences for the state budget and the economic stability of Romania.
Tuesday's decision indicates an even more complicated situation, namely that once again, PSD has taken control of the CCR, although formally it has only four judges out of nine.
- Gheorghe Stan, appointed by the Chamber of Deputies, at the proposal of PSD. He was voted by the Chamber on May 7, replacing Ștefan Minea, whose term had expired on June 15. He joined the CCR at Liviu Dragnea's proposal. His term ends in June 2028.
- Cristian Deliorga, appointed by the Senate, at the proposal of PSD. The mandates of Stan and Deliorga began on June 15, 2019. His term ends in June 2028.
- Bogdan Licu, appointed by the Chamber of Deputies, at the proposal of PSD. He replaced Valer Dorneanu. His term ends in June 2031.
- Mihai Busuioc, appointed by the Senate, at the proposal of the PSD group. He obtained 79 votes on June 24, 2025. He replaced Marian Enache. His term ends in July 2034.
The four were joined by Mihaela Ciochină, appointed by Klaus Iohannis on June 11, 2022, with a term until 2031. Circumstantially, she votes with the other 5 and Csaba Asztalos, appointed by the Chamber of Deputies, at the proposal of UDMR, with a term until 2034.
Nicușor Dan's Failure is also Evident at the CCR
In the CCR, the new USL is already functioning, and this is happening because President Nicușor Dan failed to create a liberal majority in Parliament, despite promising an alliance with Ilie Bolojan to reform Romania and limit the harmful influence of PSD in society.
This political failure of the head of state had immediate consequences on the Constitutional Court, eroding the fragile liberal majority.
On paper, in June 2025, immediately after the presidential elections and the triumphant installation of the former mayor of Bucharest at the Cotroceni Palace, for the first time since the establishment of the Constitutional Court in 1992, PSD could no longer control it, following the entry of three new judges into office.
The ideological chaos at the head of the President of Romania, the inability to lead a team and make bold and quick decisions have provided the social democrats with time and space to regain control of the CCR.
From the experience of recent years, it is clear that in Romania, it is very difficult, practically impossible, to reform public institutions, reduce corruption and bureaucracy without a liberal-progressive majority at the CCR, which has never been sustained in the long term, at least for a period of four years, between two parliamentary elections.
How Dominic Fritz Was Dismissed
In August 2026, PSD, in association with AUR and house television channels, created a huge scandal around a meeting between Simina Tănăsescu, the President of the CCR, and Ilie Bolojan, the Prime Minister.
The purpose at that time was to put pressure on the head of the Constitutional Court to withdraw from the position of rapporteur on the Integrity Law, creating a corridor for a majority that would not contest her in order to eliminate Dominic Fritz, the USR president, from the position of mayor of Timișoara. Which did happen.
Nicușor Dan is so detached from the political parties in Romania that he did not even manage to save the leader of the party he founded and which supported him in all electoral campaigns so far from PSD.
Yesterday's decisions at the CCR, the postponement on SAFE and the victory for Lia Savonea, as well as a weak government, manipulated in the shadows by Grindeanu and Olguța Vasilescu, guarantee Romania's stagnation for the next two years and provide immunity for corruption.
With a weak, disoriented president, who has entered, willingly or unwillingly, into collaboration with PSD, nothing good can happen.
Everything that has been gained in terms of reducing public expenditures, institutional reform, however little it may be, will be thrown away in the first week if the social democrats return directly or through intermediaries to the Victoria Palace.
Without PSD at the Helm
Although it has been a difficult period due to the pressure put on people by the high price of fuel, as well as the instability caused by the border war, the over 5 months since PSD has been out of government have had positive effects on the economy, creating the conditions for healthy development.
After the declines at the end of last year, the National Institute of Statistics signals a slight increase in incomes, mainly from salaries, a process generated by the private sector, according to the Biziday publication. This happened in a tense international context, without a government, but also without PSD at the helm.
