Two officers fired their service weapons during the fatal confrontation with Alex Pretti, which took place in Minneapolis over the weekend, according to an initial report from the Department of Homeland Security presented to Congress.
The report, reviewed by CNN, shows that an officer shouted „He has a gun” several times before two officers opened fire, while the agents were struggling with him on the ground.
"Customs and Border Protection (CBP) personnel attempted to arrest Pretti. He resisted CBP personnel's efforts, and a struggle ensued," the report states.
"During the struggle, a Border Patrol agent shouted multiple times: 'He has a gun!'", the document further states.
The report continues: "Approximately five seconds later, a Border Patrol agent fired the CBP-issued Glock 19, and a Customs and Border Protection officer also fired the CBP-issued Glock 47 at Pretti."
The report does not specifically state whether the shots fired by the two officers hit Pretti.
Suspicions regarding Pretti's use of a weapon during the struggle hovered over the incident, which was filmed by witnesses from multiple angles as the scuffle and subsequent killing unfolded.
However, according to the report, the officers fired their own firearms provided by the agency.
A CNN analysis of available footage of the incident indicated that an officer appeared to have removed Pretti's weapon from his belt moments before the shots were fired.
The report, a result of CBP's internal investigation conducted by the agency's Office of Professional Responsibility - which investigates potential criminal behaviors of CBP officers - is the first to be published among the multiple ongoing investigations into the shootings, including those conducted by the Department of Homeland Security's investigative agency and the Minnesota Criminal Apprehension Bureau.
The report adds that, "after the shots, a Border Patrol agent reported being in possession of Pretti's firearm. BPA confiscated and secured Pretti's firearm in his vehicle."
CBP personnel "cut Pretti's clothes and provided medical assistance, applying bandages to his wounds," the report states.
Prior to the shots, according to the report, a Border Patrol officer "was confronted by two civilian individuals who were whistling."
The officer "ordered them to move away from the roadway, and they did not move. The officer pushed both of them, and one of the women ran towards a man, later identified as 37-year-old American citizen Alex Jeffrey Pretti."
Officers attempted to arrest Pretti, and "Pretti resisted CBP personnel's efforts, and a struggle ensued," the report with initial findings states.
More than 10 minutes after Pretti was shot and killed, the Minneapolis Fire Department's Emergency Medical Services transported him to Hennepin County Medical Center, where he was pronounced dead at approximately 9:32 in the morning.
CBP investigators "were informed that the autopsy will be conducted by the medical staff of the Hennepin County Medical Examiner's Office" and will request the official conclusions after the autopsy is completed, the report concludes.
