Călin Georgescu, accused of complicity in actions against the constitutional order

The prosecutors of the High Court of Cassation and Justice Prosecutor’s Office have decided to change the legal classification in the case involving actions against the constitutional order, in which Călin Georgescu, along with the mercenary group led by Horațiu Potra, is being investigated.

The former presidential candidate appeared Monday morning at the General Prosecutor’s Office. He was summoned by prosecutors to be informed that the classification of one of the crimes he was indicted for has been changed.

Initially accused of incitement to acts against the constitutional order and dissemination of false information, Georgescu is now charged with complicity in attempted actions against the constitutional order and dissemination of false information in a continuous form, in two material acts.

"The case prosecutor from the Criminal Prosecution Section ordered the change of the legal classification of the facts for one of the defendants from the crimes of dissemination of false information and incitement to attempt to commit actions against the constitutional order to complicity in attempted actions against the constitutional order and dissemination of false information in a continuous form (two material acts)," as stated in the press release issued by the Public Ministry.

The change from incitement to complicity suggests that prosecutors seem to believe that Georgescu was not the one who initiated the December turmoil, but was merely used by the Potra group or was aware of its actions. Thus, the Penal Code states that an accomplice is someone who "facilitates, makes easier, or helps in the commission of a crime."

With Georgescu's arrival, supporters gathered Monday morning at the Prosecutor's Office for an illegal protest. The Capital Gendarmerie announces that the demonstration at the General Prosecutor's Office does not comply with legal organizing norms.

When asked by journalists why he was summoned to the General Prosecutor's Office, Călin Georgescu evaded a direct answer and redirected the discussion to the situation of the flood victims in Suceava, criticizing the authorities for their lack of response.

He stated that the real problem is the suffering of people affected by natural disasters and the incompetence of the state: "I tell you that the most important ones are the people of this country, not me... But the people who struggle and live moments of nightmare, with an incompetent state that says it has no money. It has money, and that is my statement today, if it stops giving money to others, foreigners, and stops spending money on things we don't need." He also mentioned that he was in Broșteni "as a person."

When asked if he believes there is a connection between the situation in Broșteni and the change in his legal classification, Georgescu responded in parables.

"Truth sweeps the threshold, you should know. And I have the following message: people make plans and God smiles. And there will come a moment when God will checkmate this movement, this situation. And the question I pose is: with what chess piece will God checkmate?" declared the former candidate, as quoted by Mediafax.

Accusations against Călin Georgescu

Călin Georgescu is involved in the case known as the "mercenaries' file." The General Prosecutor's investigation reveals the direct involvement of Călin Georgescu in a group coordinated by former mercenary Horațiu Potra.

The investigation targets the organization of violent demonstrations in the context of the cancellation of the 2024 presidential elections, actions investigated for actions against the constitutional order, public incitement, false statements regarding electoral financing, as well as the establishment of a fascist organization and the promotion of Legionary symbols.

Moreover, after being placed under judicial control, Georgescu publicly called on supporters to mobilize "physically," insisting that "I don't need likes... I need us to be united physically," in a move interpreted as a continuation of the dissemination of extremist ideas and instigating discourse.

Georgescu has already been indicted in a separate case, for publicly promoting the cult of persons guilty of committing crimes of genocide, crimes against humanity, and war crimes, as well as for promoting fascist, Legionary, racist, or xenophobic ideas, in a continuous form.
