The government has removed the sun tax

The government adopted, on Thursday, an ordinance that eliminates the possibility of imposing a tax on solar energy for prosumers.

„I have kept my promise to eliminate the possibility of introducing the so-called sun tax, because we aim to support prosumers and a modern, decentralized, digitized, and decarbonized energy system,” stated Sebastian Burduja, the Minister of Energy, as cited by News.ro.

Through an emergency ordinance in 2022, ANRE (National Energy Regulatory Authority) would have had the right to impose taxes on prosumers starting from December 1, 2026, if their contribution to Romania's total energy production capacity exceeded 8%.

At the beginning of February, the Association of Prosumers and Energy Communities (APCE) urged the authorities to remove this paragraph from the law, to avoid the risk of introducing this tax.

Therefore, APCE requested the Government to issue an emergency ordinance clearly stating that no tax on self-consumption ("sun tax") will be introduced, as this is not mandated by European directives.

Recently, Minister Burduja specified that the formal response from the European Commission has arrived, allowing the repeal of that article.
