The Presidential Administration explained on Tuesday why President Nicușor Dan has not yet promulgated the law regarding the judges’ pensions, even though the Constitutional Court declared the normative act constitutional. According to a statement from Cotroceni, the promulgation can only take place after the official receipt of the Constitutional Court’s decision.
„Considering the information that has appeared in the public space regarding possible delays in the promulgation process of the Law amending and supplementing certain normative acts in the field of service pensions, declared constitutional by the Constitutional Court on February 18, 2026, the Presidential Administration makes the following clarification: According to Article 77, paragraph 3 of the Romanian Constitution, a law that has been the subject of an unconstitutionality referral can be promulgated by the President of Romania only after receiving the Constitutional Court’s decision confirming its constitutionality,” the statement reads.
The Presidential Administration further specifies that "after receiving the communication from the CCR, the law will reach the President of Romania for promulgation."
Last week, the judges of the Constitutional Court rejected, after two months and five postponements, the unconstitutionality objection raised by the High Court of Cassation and Justice regarding the law on magistrates' service pensions. The decision paves the way for reducing these pensions and increasing the retirement age.
The Court stated that the objection of the High Court of Cassation and Justice is "unfounded," as the Government took responsibility while respecting the Constitution. Moreover, according to the Constitutional Court, the criticized provisions provide for a gradual transition to the new length of service and age requirements for obtaining the service pension.
President Nicușor Dan welcomed the Constitutional Court's decision regarding the reform of judges' pensions, appreciating that recalibrating the calculation method of these pensions represents an act of equity awaited by society.
