Simona Halep, $10 million lawsuit: The request made in court by our athlete

Simona Halep is facing issues in the $10 million lawsuit she filed in a New York court.

Our athlete is seeking damages after testing positive for consuming a contaminated supplement produced by the Canadian company Quantum Nutrition. In this lawsuit, Simona has also targeted the Canadian companies, Quantum Nutrition, RJ, deemed responsible for preparing and delivering the contaminated supplement, according to Gsp.ro.

However, Simona is facing difficulties in notifying these companies, as per the legislation. In this regard, she filed a request at the beginning of October to extend by 180 days the deadline for notifying the defendants, who must acknowledge officially and under signature of receipt. Without this step being completed, the lawsuit cannot proceed.

The problem is that the respective companies are doing everything possible to avoid being officially notified, thus hindering Simona. For example, when they contacted a lawyer from the Tyson & Mendes firm and asked if he accepts the notification and communication, he disappeared and did not provide any response. And this keeps happening, preventing Simona from starting the process. Subsequently, another lawyer appeared, stating that he is not authorized to accept the notification.

"Given the evident lack of professional courtesy that usually exists between lawyers and the position taken by Schinoussa contrary to the principles of judicial efficiency, Mrs. Halep's lawyer has decided that it is necessary to promptly address the Court to request an extension of the deadline to complete the notification of the defendants and for the notification of the defendant Schinoussa to be considered completed," Simona's defenders justify their request to the New York court. They base their request on "well-founded reasons or in the interest of justice," evoking even the risk for "meeting a statute of limitations."

Additionally, Simona has asked the court to proceed with the trial nonetheless, disregarding these obvious obstacles because the defendants "are effectively informed about the existence of the present lawsuit and, therefore, are well aware of Mrs. Halep's claims against them. This is evident not only due to the extensive media coverage of the subject worldwide, (...) but also because Schinoussa has hired a lawyer specifically to represent her in the present lawsuit and the same lawyer contacted Mrs. Halep's lawyer regarding the present lawsuit."
