Only forward to the second round

Everyone has the right to vote for whomever they see fit and should not have to justify their choice. However, it is desirable for them to know why they are voting, specifically whether their expectations are realistic or if they are falling for a trick.

So, if someone believes that George Simion is the candidate who represents them, they have every right to vote for him without having to explain themselves. But if the reason they want to vote for him is the promise that he will somehow bring back the second round canceled last year, they are mistaken because they are being lied to.

If elected president of Romania, Mr. Simion can, regarding the "second round back," make two gestures.

Resignation

The first option, mentioned at the beginning of the campaign, abandoned in the meantime, was to resign after victory. Of course, he can do it, resignation is a unilateral act of will.

But after the potential resignation of a president, exactly what we saw happening after Klaus Iohannis' resignation will happen. Namely, the assumption of the position by an interim and the organization of presidential elections within three months, starting with the first round and all candidates who can enter the race.

Of course, Calin Georgescu could enter the race again, although it is unlikely that a final decision prohibiting this will be made in such a short time.

But he will face the scrutiny of the Constitutional Court once again. From June, there will be 3 new judges, but a majority of 6 of those who rejected Mr. Georgescu now will remain.

If he passes the Constitutional Court and qualifies for the final, yes, Mr. Georgescu will be back in the second round, but not "back," but one resulting from new elections.

Referendum

The second option, more recently invoked, is the organization of a referendum in which Romanians will be asked if they want to resume the second round of the elections canceled last year.

"We will hold a referendum because it is within the president's duties to hold a referendum if Romanians want to resume the elections starting with the second round, that we will do justice in another way, so that the will of the Romanian citizens becomes law, we will see," said George Simion on Europa FM.

Yes, the president has the right to convene a referendum. Let's say that Romanians vote overwhelmingly to resume the second round of December 6, as they voted for a unicameral parliament of 300 members. What happens?

Nothing, but this time because legally nothing can happen. The referendum itself has no practical value. It must be implemented through other acts of the authorities. In this case, a law/ordinance/government decision would be needed to establish the resumption of the second round of December 6.

There is no doubt that the Constitutional Court will declare the unconstitutionality of such an act, as it would contravene Constitutional Court Decision 32/2024, which annulled the elections.

Let's remember that the Constitutional Court declared unconstitutional the law through which the Parliament tried to implement Klaus Iohannis' 2019 referendum, regarding the prohibition of amnesty and pardon for corruption offenses.

Moreover, how would the operation be carried out?

If President Simion were to resign, the constitutional provisions would apply, meaning new elections from scratch. To avoid them, the Constitution would need to be changed. This would involve another referendum. And how would the amendment sound: after the resignation of a president, the second round of 2024 elections is organized? Always?

Legally, there is no longer any legal way, no act by which the second round of canceled elections, followed by completed new elections, can be resurrected.

I hear commentators saying that the authorities must find a solution. In other words, who made the mess should clean it up, right?

In fact, George Simion knows that there is nothing to be done and he has no intention of doing anything. Once installed in office, his last concern will be to revive Calin Georgescu buried with this victory of another sovereignist. His concern will be to consolidate his power, not to put his mandate on the table.

Just as his concern now is to stay as close as possible to the picture of Calin Georgescu in the window, whose electoral pension he wants to cash in.

This is what Calin Georgescu knows as well, which is why he refuses to give him explicit support. With Simion's victory, Georgescu will no longer mean anything. With Simion defeated, extremism will continue to long for its great leader.
