E-Scooters and Bikes Now Require Insurance Under New Law

The Chamber of Deputies adopted on Wednesday, as the decision-making body, the Mandatory RCA Insurance Law project, which will include vehicles that are not subject to registration, such as electric scooters and bicycles, under the compulsory insurance scheme.

The purpose of the law is to transpose the provisions of Directive (EU) 2021/2118 of the European Parliament and is initiated by the Government.

In the explanatory memorandum, the Government specifies that through this project, the definition of a vehicle is expanded, so that the insurance obligation will be related to certain technical criteria.

Other changes brought by this draft law include:

  • setting minimum compensation limits
  • establishing their reference in lei at the rate indicated in the directive,
  • the method of monitoring RCA insurance.

"The owner or user of a vehicle that is regularly parked in Romania must conclude and maintain valid RCA insurance to cover the risks arising from its use.

Individuals and legal entities using vehicles exclusively for motor sports events and activities, including races, competitions, training, testing, and demonstrations taking place in Romania in a restricted and marked area, are exempt from the obligation to conclude an RCA contract when the event organizer or another party has concluded optional insurance or has an alternative guarantee instrument covering damages caused by vehicles to any third party, including spectators and other individuals present, but not necessarily covering damages caused by participating drivers and their vehicles," the project states.

The project was adopted in the form submitted by the Government. All amendments adopted by the Senate were eliminated, and those submitted by the deputies were rejected.
